What is Mediation?
Mediation is a process where two or more parties agree to meet in an effort to resolve their differences. It is a collaborative effort between each side supervised by an impartial mediator. A skilled mediator will guide the conversation to isolate core issues, identify mutual interests, and brainstorm possible solutions. The organizational process is a key reason why mediation is often successful.
Why Choose Mediation?
One of the most significant reasons mediation is chosen is because each side maintains control of the outcome. Who better to decide your fate than you? Agreements reached in mediation can be creative and flexible, tailored to the specific needs of each individual involved. Conversely, either side has the right to refuse to enter into an agreement if they disagree.
Mediation is private and confidential. Prior to beginning your session, all individuals involved will need to sign the Guidelines of Mediation. These guidelines highlight the rules governing the discussion which includes a confidentiality clause. Privacy not only protects your information, but also your reputation.
Mediation is an ideal way to avoid costly and time-consuming court proceedings. Mediation is typically less expensive when compared to attorney fees relating to a trial. Attorneys are not required in mediation but are always welcome. Always keep in mind that going to court without legal knowledge usually leaves you at a disadvantage. In addition, mediation can be scheduled at your convenience. Court dates are often determined by the availability of judges and courtrooms which may extend the time it takes to resolve your conflicts.
What to Expect
Prior to your mediation session, you will need to prepare. The preparation involved will be unique to your situation, but in general you will need to bring any written documents that may be useful in helping the other side understand your point of view.
Mediation should be a safe and comfortable experience for all those involved. The session will be held in a mutually acceptable location. Alternatively, Zoom may be utilized if all participants agree.
On the day of mediation, please arrive a few minutes early. Sessions will begin promptly. The mediator will begin by explaining the Guidelines of Mediation. These are the rules that govern the conversation, and all individuals present will need to sign this document.
Immediately following, the person(s) bringing the complaint will start by giving an overview of the situation from their perspective. The other party will then get a chance to respond and give and overview from their perspective. Conversation will then ensue in an organized fashion. The mediator will also have a chance to speak to both sides separately. This will give each side a chance to share sensitive information with the mediator while maintaining privacy.
If an agreement is reached, the specific details discussed will be documented in writing. The responsible individuals will then sign the document and receive a copy. The Mediated Settlement Agreement is a legal document enforceable in a court of law.
